944.17 (1), Stats., on December 23, 1968, and on December 30, 1968, he was sentenced by Circuit Judge Hugh R. O'Connell to
an indeterminate term of not more than five years in the state prison. An appeal has been taken from the conviction and from
the sentence. The appeal is based upon an alleged alibi. It is contended that at the time and place the offense was committed, the defendant
was elsewhere and that, as a consequence, the finding of guilt is contrary to the great weight and clear preponderance of
the evidence.
